LEGAL REQUIREMENTS FOR ELECTRONIC RECORDS

Introduction to Legal Requirements for Electronic Records-Issues and
Challenges
What has been the influence of Sarbanes-Oxley, Arthur Andersen, litigation
and discovery, and legal compliance requirements on recordkeeping and
records retention programs? What legal principles affect all records, paper
records, electronic records, electronic images and other reproductions of
records? In fact, what is a record and what is not a record?
 
Electronic Records as Evidence 
Review the key laws taken from the Uniform Rules of Evidence, Uniform
Electronic Transaction Act, Uniform Photographic Copies of Business and
Public Records as Evidence Act, and other sources and court cases that shape
the laws of records as evidence and the legal status of records, generally.
Review the criteria for admitting original, duplicate and electronic records
into evidence and, thus, the legal standards for records and information
management programs? What are your duties and responsibilities regarding
records as evidence? 
 
Managing Electronic Records For Legal Compliance
While the law does not spell out specific recordkeeping systems for
electronic records, legally compliant and legally defensible systems must
have certain, basic functionality. What is the "magic formula" for a legally
compliant system? Why should you develop a legally compliant program now?
Learn the Internal Revenue Service guidelines for appropriate recordkeeping
systems for tax records maintained as electronic data or electronic images.

Records Retention For Electronic Records
What is a records retention program? What are the basic legal requirements
for a records retention program? How should these requirements be applied to
the retention of electronic records? How should retention be applied to
email records and what impact will this program have on the "corporate
culture?" Is there a difference between backup and off-line storage? How do
we ensure that electronic records are maintained for the required retention
period?
