Sent to you by pakurilecz via Google Reader: Mo. Governor's Actions Not
Criminal via Death By Email Blog by Roger Matus on 3/5/09
By failing to preserve many emails as public records, a 16-month
investigation concluded that former Missouri Gov. Matt Blunt’s office
did not follow two state record retention laws, but investigators
decided the violations were not criminal. They did not refer any
findings to a prosecutor.

Investigators have concluded that former Gov. Matt Blunt's
lawyers "lacked knowledge" of the state's open records, which led
to "inadequate" record retention policies and practices for storing and
archiving old emails. The investigators stopped short of saying that
Blunt had specific knowledge of the legal compliance issues, in part
because they were unable to interview him.

"Absent the opportunity to conduct an interview, the (investigative)
team is unable to determine if Gov. Blunt had … any independent and/or
special knowledge that might negate any good faith belief he had in the
incorrect legal advice that he received as governor from his general
counsel, Henry Herschel," the report says.

The report is inconclusive on the most explosive issue that came up
during the investigation: whether an employee or employees of the
governor's office sought to destroy records on the backup tapes. There
is insufficient evidence to "prove or disprove" that allegation, the
report says. (Kansas City Star and St. Louis Post Dispatch.)
