Bob, I'm not a lawyer either, but I think the issue was one of
converting records kept in a native format and subject to a discovery
request to a non-native format to make the discovery process more
difficult. Had the records been maintained in a non-native format before
the discovery request, as part of the normal record keeping practice, I
don't think it would have been an issue. Of course, if one does that
conversion as part of normal course of business, the records may lose a
large degree of functionality, which is probably why they were kept in
their native formats to begin with.
