Hi Donald --

If you're about to re-start records destruction after a dormant period and you need to modify the retention period for a class of records in order to destroy some, perhaps it's good to get a legal opinion and opinion letter on the applicable regulations and the new retention period for the records from an attorney.  This would serve you well if an issue arose later or if your litigation department has any volume of open cases (they may have some risk aversion if so).

Ryley Carlock & Applewhite does a lot of legal research and records work in environmental, mining, and nuclear industries and provides a research service on retention laws and schedules.  You might reach out to Lorrie Luellig, the lead attorney on records research/schedules at RC&A.
