true but in the the world of ERMS you must "declare" a document a record in
order for it to be placed into the records repository. this is an action
that can be done automatically as part of a workflow or manually  by a user.

technically yes, but now under the FRCP you have to have a "meet and greet"
where the parties to the litigation determine what will be turned over as
part of discovery
