I recently came across the case referenced in the two documents above which I thought were interesting in that they emphasized the importance of good record keeping. I thought it was also noteworthy that the defendant in this case tried to argue that its online customer activity report was not a corporate record. They suggested that customers use such information at their own risk and that the company is not responsible for any errors that may be contained in such information.
