This ( http://bit.ly/a6v8TS ) was a rather interesting article and it raises
some issues that may be critical for those of us in this field to consider.

Make sure you understand who regulates what the requirements are for the
industry segment and marketplace you work in.

Determine what policies exist internally and if the practices and processes
that support them are adequate to ensure compliance.

Understand WHO has liability for WHAT when it comes to developing, auditing,
communicating, and following the policies for compliance with regulations
within your organization.

As soon as you become aware of a potential or actual legal action involving
your organization, communicate with the necessary parties of the potential
need to preserve information FORMALLY and retain a copy of all communications.

When you are aware of any potential violation of compliance with any stated
policies that you have responsibility to monitor compliance with, formally
inform legal counsel or other management and absolve yourself of responsibility.

Not everyone in an RM role has responsibility for compliance or auditing,
and few that I'm aware of are in the position the individual in this article
was in... but if you know there is a policy and it isn't being followed, you
can still help your organization avoid getting into a similar situation by
alerting others to the concern. Documenting your actions may be what
separates you from a fine, a 2 year suspension, or an orange jumpsuit in the
future.
