State Cases/Rules - New York - Schreiber v Schreiber

Schreiber v Schreiber, 2010 NY Slip Op 20271, 6 (N.Y. Sup. Ct. June 25,
2010). In this divorce action, the wife sought a forensic image of the
husband's, an attorney, hard drive because she suspected him of hiding
matrimonial assets. The Court allowed for the forensic copying of the hard
drive but permitted no further inspection until an appropriate protocol was
in place. The Court set forth a proposed list of items and explanations that
the protocol should contain including;(a)Discovery Referee; (b)Forensic
Computer Expert; (c)File Analysis; (d)Scope of Discovery; (e)First-Level
Review; (f)Second-Level Review; (g)Discovery Disputes; and (h)Cost Sharing.
