In a recent New York case (People v. Kent), an appellate panel in Brooklyn
decided that browser history and cache files could serve as proof of child
pornography charges. Don’t let the fact that it’s a criminal case and the
attention-grabbing subject matter obscure the important reminder this case
offers. You need to know how much and what kind of cache you’re carrying and
whether you are obligated to preserve or produce cache in litigation.
