While this is a records management discussion and issues of whether a memo you write is your own intellectual property or the company's when you realize that people were injured and someone died as a result of this explosion.  This is a wrongful death case not an issue of simple records management.

Also the public good comes into play as a Whistleblower situation arises over whether or not new explosions and deaths could occur. As a citizen, the right for citizens to be safe in their home trumps a corporation's privacy rights.

Just as a police office may enter a home without a search warrant if there is a threat of eminent danger, the ongoing threat these pipelines may represent require special circumstances.  The current management is not given the benefit of knowing what past behavior may have created in terms for risk for the current stockholders.

The same management team that failed to maintain adequate records, is not the same team in place now.  These officers have a right to know, just as the public whose's homes sit on the pipelines have a right to know. 

Larry did the right thing, regardless of the semantics.  If it is your family at risk, that is the way you would decide.

As LBJ so wisely said "It is not doing the right thing that is hard, it is knowing what is the right thing?"
