Sorry for a delayed reply to the 'Documenting Disposition Error' posts.  In a previous career as a Compliance Director and Privacy Officer for a healthcare vendor, I would also suggest the parties review their HIPAA Business Associate contracts and related HIPAA self reporting requirements for the premature or accidental destruction of healthcare records.
