No spoliation when document destruction complies with company policy -
Lexology
With every new case in which *spoliation
<http://it-lex.org/category/ediscovery/spoliation/>* is alleged, people
hopefully become more aware of the boundaries of what constitutes criminal
destruction of evidence, and what a proper records retention policy looks
like. A recent decision from the District Court in the Southern District of
Illinois has further clarified those boundaries in its recent ruling
on a *motion
to compel <http://it-lex.org/wp-content/uploads/2013/10/Pradaxa.pdf>*. The
clarification rests upon the imminence of litigation and the temporal gap
between employee termination and document destruction: both standards were
more relaxed than you may think.
