This is the part of the controversy that is particularly troublesome for me.  From the email that was sent out:

" When they delete the e-mail, they need to then "empty the trash" Please have them do this immediately. All other records with the exception of the latest plan should be destroyed -- shred. The reason is to protect against an Open Records Request.  Thank you for doing this and for verbally communicating this with staff. I do not want this put in writing."

It reeks of the Arthur Anderson case.  There is no protection against an Open Records Request, the request will either happen or it won't.  The protection is against what you said or did, via email or paper, and being held responsible for that.  As the story said, this is an emotional issue, especially for the parents.  However if there was deliberate destruction of records to hide something that would have caused embarrassment to the school district, that is just plain wrong.
