Open records does not mean they have to be available forever. If you post 
your records retention schedule and make it clear that certain documents 
and data will only be available for X period of time, then I would think 
that would cover you for documents and data that are no longer available 
because they've passed their retention period. You might be in more 
trouble if the documents or data are still available after they were 
supposed to be destroyed IAW your retention policy. Then you could be 
shown to be guilty of not following your own policies.
The real risk is that documents or data that you've destroyed IAW your 
retention schedule can still be "out there" because someone downloaded or 
copied it before it was destroyed. But that is a risk that I would guess 
is common to every entity that has public records.
