Many Federal, State and Provincial regulations include sanctions that
can be incurred by organizations for non-compliance, however, I have
rarely seen any actually imposed.  I am thinking specifically of the
regulations that relate to records retention - for records being
retained either too short or too long a time.  Discovery and the claim
of spoliation seem to be the primary examples of courts acknowledging
that retention policies are not being implemented, but even then it
seems that on appeal most companies are excused.  

Does anyone have concrete examples of penalties being imposed on
organizations for improper records management?
