Another reason to avoid long-term retention of back-up tapes is that
it's usually impossible to say exactly what is contained on those tapes.
Without knowing their contents, it's impossible to say that they do NOT
contain something that might be responsive to a discovery order.  So,
with every new litigation you may have to either produce the contents of
each tape or prove that there's nothing on them that's responsive.  If
your organization is subject to multiple, overlapping litigations, this
could mean that you'll NEVER be able to get rid of the buggers (and the
cost of producing their content will continue to rise as the requisite
software/hardware become progressively more obsolete).
