I found a copy of the US District Court decision in the case of "Carlucci v. Piper Aircraft" in the book "Law, Records and Information Management: The Court Cases" by Donald S. Skupsky and John Montana. There are also a lot of other cases referenced in this book under Chapter 9 - Destruction of Records under a Records Retention Program.

Hope this helps.

Subject: Re: [RM] Looking for Court Cases

The old chestnut here is Carlucci v Piper Aircraft. There are both
trial court and appelate opinions published. I wrote an article on the
topic for IMJ some years ago that also cites others. It doesn't appear
to be available at the ARMA bookstore, but if you have all your old
copies of IMJ, you might be able to find it. The cases are still good law.
