"The changes also allow databases of U.S. civilian information to be given
to foreign governments for analysis of their own." This is worrisome, in
particular because that might get handily around the 5 year rule. This
type of information exchange has been known to happen between the UK and
Germany, for instance, with regards to DNA sample information and
fingerprints: one agency would request a copy when the time was running
out, and that requesting agency could then return the information at a
later date, due to some change in the suspect's status for example.
Now, as to them keeping all sorts of information, they particularly do
this when transiting a port (or within 50 miles of a port): DHS maintains
that they have the right to make a copy of any digital device, keep that
copy for an unspecified amount of time, and share it with other agencies.
It's something I worried about, traveling back and forth from the UK,
carrying 3 laptops, each of which had client information and / or
personally identifying information. VPN's and encryption were the easy
answer, along with sdelete. At some point you have to make a call as to
