This is an excellent publication. Thanks Ginny!
One of the informational items in this publication shows why this debate
about the conflict between Public Records and Privacy will not be resolved
any time soon. Page 9 of this report says:
"The common laws of privacy generally recognizes four types of privacy tort:
1. Intrusion -
- intrusion upon seclusion ‐ unwelcome or unauthorized invasion upon the
solitude of another or upon his or her private space or affairs
- an intrusion that is offensive or objectionable to a reasonable person
- an intrusion upon a private matter
- an intrusion that causes anguish and suffering"
Etc.
Here are the kinds of individuals that were identified by location in the
release of Public Records:
1. Battered women hiding from husbands that felt they needed to protect
themselves
2. Police officers with families that had participated in putting criminals
in jail
3. Witnesses against criminals
4. District attorneys with families that had prosecuted and convicted
criminals

Will these individuals have cause for litigation if they are harmed due to
this release of Public Records by the Journal News? Will the Privacy issues
prevail over the public's "need-to-know" and the Journal News claims of
First Amendment rights? We have a direct conflict here between Public
Records , release, use and Personal Privacy. And, once again, the Records
Manager in the middle will be expected to follow whatever Public Records
laws are in place.

Every state has variations on what may be exempt from disclosure under their
Freedom of Information or Sunshine Acts. Also, most states have some
version of a privacy law that further defines what may or may not be
disclosed and to whom. What is considered accessible will vary from state
to state. I researched Privacy Laws in 2009 for ARMA Intl. Education
Foundation. The paper is a free download at
