While not in the legal field I think I would look at this situation from a "how would I like to be treated" view.    I'd expect my legal representative to tell me what happened and to do so as soon as possible.    I may be in a position to recreate the documents or obtain them from another source but the time to do so would be now, not years from now when that possibility may not exist.
