I do not agree with the above.  Everything is copyrighted, not everything is identified with a copyright or has been registered (the part that makes is public).  Virtually all confidential materials received from vendors are copyrighted including materials that that contain confidential,  sensitive or trade secret information. Software is a common example.

Public institutions have been down this path before.  The terms under which the materials are provided is the controlling factor as to whether the records are public, not the funding mechanism.
