Charlene,

You will want to determine if, where you live and work, deeds are routinely recorded by the county Auditor or State. If so, this will reduce the burden for your organization to keep in your archives such documents. Regulations about who is the legal owner when a property sale is made vary significantly from state to state, and even county to county, but a sale does not always mean the property has changed hands until a loan or lien on the property--often a mortgage--has been satisfied. In other places, once the deed is recorded, the title holder is the legal owner even if there is money owed to another party. Property can change hands by inheritance, and the documents required to show ownership vary with this also.

I would research carefully what documentary requirements are in force in the area in which you live and work before setting out to argue one way or another.

Just my 2 cents worth.

Subject: [RM] retaining copy of sold property deeds after sale - informational value

Hi everyone, it's been awhile since I posted - hope all is well!
I am an archivist working on (1) archival and (1) record collection. I want to make the argument to my corporation that property deeds have historical informational value to them after the property sale. . .
