A good analysis of FACTA, but the consumer doesn't read the law. The
consumer only knows that there exists a law that requires that a
company properly destroy consumer information. The consumer will
assume it applies to everything, not just consumer reports.
Folks should also be aware that the state of Texas recently passed
legislation (HB698) related to the (disposal of certain business
records that contain personal identifying information". The law also
assesses a civil penalty of $500 per record improperly disposed of.
The law does have a safe harbor provision if a company has contracted
with a third party for the destruction of records.
