Bridgette,

You should definitely consult with you legal council.  Also, 42 CFR may give you some help.  I am not sure if it will be specific enough to answer your question directly but it will give you some direction.  Don't forget about your state statutes.  They may provide some retention guidelines as well.

Greetings,

 

I am trying to determine the retention period for two groups of records.


 

The first group of records contains personal and medical information
about minors who participated in a denominational national meeting
event. My guess is that they should be retained until the minors turn 18
years old, but I am having difficulty finding documentation for that
retention. How long do minors and/or their guardians have to place a
claim (medical or otherwise) for this event? 

 

The other group of records contains information about the adults that
volunteered to work with / chaperone the minors mentioned above.
Background information is provided by the applicant only. One concern I
have is the atmosphere of claiming misconduct in religious organizations
several years after the event, due to the very public incidents in the
Roman Catholic Church over the past few years. Again, I am finding
difficulty locating retention documentation for these types of records.

 

Thank you for any help you can provide. Examples of what others use for
retention for these or similar records, or places to look for retention
are extremely appreciated.
