'Racy' emails could stay hidden under Pennsylvania open records law |

HARRISBURG — If state employees use government computers to send fantasy
football news, horse racing results, online auction links or pornography,
the public probably is not entitled to obtain the emails through an open
records request, legal experts say.

Though the employee could be disciplined or even fired, depending on agency
rules and the offense, these types of personal emails are not defined as
“records” under the state Right to Know Law because they typically don't
concern a transaction or business of the agency, said Melissa Melewsky,
media law counselor for the Pennsylvania NewsMedia Association.
