ALBANY - A one-time top aide to Gov. Andrew Cuomo testified that he was
"aghast" over the state's apparent deletion of emails he wrote in 2013
seeking the removal of the "Wandering Dago" food truck from the Saratoga
thoroughbred track because officials found the name offensive.

Bennett Liebman, Cuomo's former deputy secretary for racing and gaming,
said in a deposition that he was never directed by attorneys for the state
to preserve the emails, although Liebman, who is an attorney, said he
thought the emails could be germane to a legal case against the state.

Liebman said he was "aghast" that Cuomo's office made no clear effort to
save the documents despite a pending Freedom of Information Law request
from The New York Times.
