Hiho, thanks for the clarification; I would like to comment upon your
comment on the lack of "judiciary power" for the Board to apply the present
Code.  It has always been my understanding codes of ethics and conduct are
based in moral behaviour and that breaches of the agreed upon code of
behaviour are viewed by the Ethics Committee in that light; for the Board to
have "judiciary power" I believe the ACA would need to become a legislated
self-governing body.  Is the ACA Board considering such an initiative?

Dear Sarah, Anna, and all,

Thank you for asking for clarification about the abolishment of the ACA Code
of Conduct.

A previous ACA board developed the code in 2014 with the best of intentions.
However, in the two years the Code has been in effect, it has proven
inadequate in meeting the needs of the ACA as well as of those attending our
conferences. The Code is not enforceable, as the ACA Board has no judiciary
power to determine breaches nor impose sanctions without taking on legal
liability.

Therefore, this Board has decided to incorporate carefully articulated rules
of conduct in the new Code of Ethics and Professional Conduct. The Ethics
Committee is currently working on this important endeavor. Please be assured
that we are committed to a safe place for our members and conference
attendees. The Board will approve the new Code at its pre-conference
meeting, however preliminary work on this will be communicated to members
prior to the conference. The Code will be provisionally in force during the
conference after board approval until it is fully ratified by membership at
the AGM. We hope these actions allay concerns we've heard from members about
the abolishment of the Code of Conduct and the lack of a code during the
conference.

Good morning
I would like to add my voice to Sarah's and urge the Board to keep the
current Code of Conduct in place until a new one can be developed. It isn't
clear what the Ethics Committee's timeline is for their survey and
development of the new code, so it seems wise to leave the current one (even
if it is flawed) in place.
Not having a code of conduct in place, particularly when the ACA conference
is a few months away, could have a detrimental impact on registration.
Codes of Conduct are important policies that help buttress efforts to
cultivate greater diversity and inclusivity within the profession; they are
ways of signaling to our members (and potential members and participants in
our events) that we take their comfort and safety seriously, and that we
have protocols in place to address potential conflicts that might arise.
They are also useful tools in establishing or reinforcing our shared values.
Many tech conferences I've attended actually use them to promote and market
their events.
