The judge was unhappy with this maneuver, writing that Rule 34 of the Federal Rules of Civil Procedure prohibits “simply dumping large quantities of unrequested materials onto the discovering party along with the items actually sought.” The judge also frowned on the SEC’s claim that the plaintiff’s attorney could locate the relevant information by merely reviewing the submitted e-documents. “A page-by-page manual review of ten million pages of records is strikingly expensive in both monetary and human terms and constitutes ‘undue hardship’ by any definition,” wrote Judge Scheindlin https://urldefense.proofpoint.com/v2/url?u=http-3A__bit.ly_2OwOf2D&d=DwIFaQ&c=pZJPUDQ3SB9JplYbifm4nt2lEVG5pWx2KikqINpWlZM&r=b5NZPQUb9_r2rQ3Zd74ATT3aSs9yKyRnJLOhqJvd7fE&m=KtpRt3rUP5BIgCsdm1Up-ggFB9bBQduAwae7PJ3MFJ0&s=HGxXctyXepamUtfLSMmBsoBALMGusIuJ7U7GQwctVp4&e= https://urldefense.proofpoint.com/v2/url?u=http-3A__bit.ly_2OwOf2D-2B&d=DwIFaQ&c=pZJPUDQ3SB9JplYbifm4nt2lEVG5pWx2KikqINpWlZM&r=b5NZPQUb9_r2rQ3Zd74ATT3aSs9yKyRnJLOhqJvd7fE&m=KtpRt3rUP5BIgCsdm1Up-ggFB9bBQduAwae7PJ3MFJ0&s=1KO8Fr5NeuOIZ1XboWpNu1t9pUzb7vHa1Xd6QWLaUI0&e= -- Peterk Dallas, Tx [log in to unmask] Save our in-boxes! https://urldefense.proofpoint.com/v2/url?u=http-3A__emailcharter.org&d=DwIFaQ&c=pZJPUDQ3SB9JplYbifm4nt2lEVG5pWx2KikqINpWlZM&r=b5NZPQUb9_r2rQ3Zd74ATT3aSs9yKyRnJLOhqJvd7fE&m=KtpRt3rUP5BIgCsdm1Up-ggFB9bBQduAwae7PJ3MFJ0&s=cX5yJCot6AqEFcZmDkeqh-v8DIhxmZSl5MCDhBJCKkE&e= “If only there were a massive entity that I were forced to fund to tell me how I should live my life, since I’m so obviously incapable of deciding for myself.” M.
