Steve,

Yes I agree that you should have tough language in your contract. This 
language should facilitate your move to a new vendor in the event of 
breach.

The simple notion that you would stay with an inept vendor because you 
could fine them seems to not acknowledge the criticality of the data.

As for the chain of custody and tracking solution. Most customers simply 
put all of their tapes in a box and get a receipt for the box. If a given 
tape goes missing there is simply no audit trail. 

Do you have tape level chain of custody?
