I agree with the court. My only concern from a records standpoint would be 
if any of the messages had partial records content and whether they were 
redacted prior to any disclosure. The non business use of the system is 
really an internal matter seperate from records. It would fall into the 
realm of internal discipline or in this case constituent action.
