I am not talking about birthdates. I am actually talking about the
employees age. They were listed like: Sr. Account 59, Records Admin 46,
Operations Manager 60, etc. The company has an extremely flat org
chart. Meaning only one person per position.

I know the last 3 law firms I've worked for all removed
birthdates from their public information. If you want to be included on
the firm birthday schedule, only the month and day are reveled and you
must give permission for it to be posted.

Thanks so much for your reply, Doug. Seems to be the consensus that it
should not be done, but no actual rule or law against it.

One reply mentioned the Older Worker's Benefit Protection Act, which I
then queried and only found that An HR department may make a list to
prove they did not discriminated against anyone, but I would believe it
should not be distributed.

Any response to that from the list?

Tracey

Great question. Were I an attorney, I'd recommend against it, since it
could be used as evidence that an organization had engaged in age-based
discrimination in promotions, layoffs, etc. It would be quite difficult
to explain what purpose such a list would serve, OTHER than to promote
age discrimination.

(not an attorney, but glad I married one!)

I have a question regarding the privacy rights of one's age. Is a
company allowed to distribute a list of everyone of their employee's
ages to everyone of their employees?
