Reposting into this thread and still wondering:

If you haven't heard, the National Football League conducted an internal
investigation last fall into allegations that one of its member clubs, the
New England Patriots, were videotaping the activities of other teams at
times or in ways that could be against league rules. A determination was
made that the Patriots violated league rules and the club was penalized
$250,000, the coach Bill Belichek was fined $500,000 and the club lost their
first-round draft pick in the April draft.

As part of the investigation, the Patriots submitted video tape evidence
requested by the league. After the penalty was assessed, the NFL destroyed
the video tape evidence.

I guess I'm wondering if the NFL has a retention schedule and if so, what
their retention period was on internal investigations and the records
related which in this case may have included video evidence submitted by the
team. What has it done with the video from other internal investigations?
Unless there is something deeper related to the government's granting of the
NFL's anti-trust exemption or the governmental contracts member clubs have
with municipalities regarding stadium financing, I doubt there are legal
requirements. Certainly there could be considerations. Could they have
reasonably understood that additional litigation or investigation (Sen.
Arlen Specter's (R-PA) threat) could come from the investigation?

Any comments from the list? I thought it would be a good Super Bowl records
management topic.

Tom

Subject: RAINDrop - Senator Asks Why NFL Destroyed Tapes

Since this is Super Bowl Sunday guess it is appropriate to post an
article about football. If he were a Jets, Chargers or even Colts
fan, I can somewhat understand being upset. But Spector's team is the
Eagles which came last in the NFC East - give me a break...

WASHINGTON -- With the Super Bowl fast approaching, a senior
Republican senator says he wants the NFL to explain why it destroyed
evidence of the New England Patriots cheating scandal.
