Sorry, Peter, there's no significant difference: the Afghan war records have been--and are still--being created by the US (and other countries, including France) on Afghan soil as part of the administration and conduct of the war by the Allies in the course of a United Nations-approved operation.
And for your information, Algeria was NOT considered by France (or other countries at the time) a colony--it was part of "Metropolitan France". Morocco, in contrast, was a "Protectorate".
Of course, any lawyer can make any argument she/he chooses.
