"Again, no custody,  so how can they exercise control?"

We have warnings in our policies that organization has full right to check our personal emails and our "Internet" activities when we use organization's IT equipment - server does not belong to me, but it is organization's property.
The same warning  is right when I check my bank account at work during my lunch break.

Also, if I understand it correct, organization has full right to request court to grand access to my personal e-mails in case organization has something in mind, and court will give it.

Regards,

Alex Babin
