 I'd point out that law enforcement in Europe routinely does this in order
to sidestep retention rules - for example, the UK police may not have
enough evidence for an arrest and are required to destroy evidence after a
period of time (fingerprints), so ask some friends in Germany to request
the evidence prior to its destruction.  The evidence is then subject to
German retention rules, and can be requested of the German authorities at a
later date.

 I'm not saying it's right, or even legal, but that it's done.  And, of
course, who will prosecute?
