I no longer work for a law firm, but did manage the Conflict of Interest
team for 3 years at the firm I used to work for. We considered the
conflict reports as part of the matter intake process (including all
research performed prior to opening the matter), and retained these
documents in accordance with our matter retention requirements. For most
matters, this was 10 years after the matter closed.
If/when questioned or challenged (and, yes, this did happen), we needed to
be able to demonstrate exactly what names/terms were searched ‹ and
cleared (or dealt with in other ways) ‹ during the conflict clearance
process.
