No Spoliation When Document Destruction Complies With Company Policy |

The Court ruled that no matter which standard the parties attempted to use,
the duty to preserve is only triggered when a company actually or
constructively knows about impending litigation. When using this standard,
BIPI was deemed proper in its destruction of documents in accordance with
its document destruction policies.
