“There’s no doubt that in overtime lawsuits — as well as just about any
other lawsuit these days — electronically stored information is an issue,”
Finucane said. “In overtime lawsuits, employees can whip out emails that
can offer some proof for their claims that they worked extra hours. The
Fair Labor Standards Act is about 80 years old, so the electronic world is
catching up to it, and it’s becoming an issue in our lawsuits.”
