As someone already said, it is possible that a records custodian went to prison for destroying records illegally (i.e. not in accordance with retention requirements), but I don't think it happened very often or even recently.  The whole point behind establishing consistent disposition procedures and documenting each destruction or deletion is to prevent records managers from finding themselves in this type of situation.  Once we train others in the organization in the approved procedures and monitor what we can, the "guilty" party will be the person who did not follow the procedure and they will have a difficult time using the excuse "I didn't know" if we document the training (especially the attendance).

Don't want any names , but I would like to know.  We have fiduciary responsibilities for records and we follow regulatory statutory requirements and follow guidelines standards and processes, but the recent news about emails being deleted and possible 20 years in prison for each count, made me think about this.  Without a doubt I do know that we could suffer if we willfully destroyed evidence but what if we made an innocent mistake?
