Breathe easier, Jeanne. The issue of documenting destruction is quite 
separate from whether or not they are records. In many cases the 
certificates of destruction of data on backups would be well nigh 
impossible because the tapes are simply written over. And that is easily 
documented in your tape rotation schedule policy. 
If you have a record series that includes your Certificates of 
Destruction, I see no problem with including the certificates from your 
backup tapes. Whether or not records managers consider backups as records, 
opposing counsel often considers them fair game in discovery. So 
documenting you backup rotation schedule and tape destruction to show that 
it is done as part of your normal course of business cannot hurt.
