Students of the early history of e-discovery are familiar with the steady
stream of opinions imposing sanctions against parties who failed to
preserve electronic evidence (a type of “spoliation”). In many of these
early cases, spoliation could have been avoided if basic steps had been
taken towards e-discovery preparedness. Such steps do not involve expensive
state-of-the-art technical solutions, but rather low-cost, fundamental
measures that can instantly reduce high-risk exposures.
