"FOIA creates no obligation for an agency to search for and produce records
that it does not possess and control," Justice lawyer Matthew Collette and
Catherine Dorsey wrote in the government's first written court submission
on the Hillary Clinton email issue.
And here lies part of the problem. This statement is true. I had a FOIA
request one time that involved an e-mail form an AKO (Army Knowledge Online)
account. Because the e-mail was sent from an officer's AKO e-mail instead of
his "official" Army e-mail, he did not have to produce the e-mail under the
FOIA. I fought that because I felt it should have been released, but I lost
the argument due to a technicality that the AKO was not the "official" e-mail.
