Irrespective of cloud or "internal cloud" based, the determination should
be made based on the most pressing need identified by the organization and
the client base.

Generally during  the development of a functional requirements document,
you identify the 'functions' that are most needed and those become part of
your selection criteria for a product/service to manage your content.  If
they don't offer the "need to haves", then they don't make the short
list... if they DO, but fall short on the "nice to haves", then, you need
to look a bit deeper.

Numerous products/services add certain level of functionality by including
modules or (gulp) adding third party integrations after the fact, so you
may not see Legal Holds or RR being available OOTB, it may come later.

In both cases though, you typically have administrative tools available to
suspend destruction of content at a variety of levels, which would mimic a
legal hold, or even prevent destruction until a retention module is made
available... but in either case, when they DO become available, someone is
going to have to go back and "touch" the content to add these features at a
folder or item level.
