Looking for the retention other law firm's place on residential real estate (RRE's) closings. We currently have a permanent retention on RRE's, but I'm questioning that logic. If the original materials are given to the client at the close of the matter, is it necessary for us to retain copies forever? Does the client not have to accept some accountability for future issues? Would a 20 or 30 year retention be acceptable? Too much? Not enough? We are still housing REE's as far back as the 1920's.

Thoughts, logic and/or ideas are always appreciated.

Tracy,

You might consider researching the statutes of limitations for actions on the sale of real property in the states in which your firm operates. That might establish an end point where your firm is no longer liable to be sued for their role in the closings.
