Sue, personally I wouldn't have a problem with that service level, particularly if it was an expectation set forth in the contract (which I don't get the impression yours is).  However, to put my opinion into perspective, my industry is not highly regulated and we are not often involved in (as parties to) litigation.  I'm honestly just thrilled if my lawyers let me throw anything away at all!

Anyway, I would suggest you evaluate what effect the variable of time has on your risk exposure, and then decide if a 3 month turnaround is acceptable or not.  If it's not acceptable, you should be able to negotiate with your vendor on the level of service (and associated price).  If they don't want to/can't meet your expectations, you certainly always have the option of pulling the material from storage and having another vendor handle the destruction.

To the folks who responded earlier - I'm interested to understand why you felt it seemed she was talking about an in-house operation.  I didn't get that impression at all and am curious to understand what I missed!
