<I also don't want to provide the vendor (who has a consulting arm) with my retention schedule and accompanying research. I'm not suggesting that the vendor would review that information, but frankly, I don't know what happens behind those doors and I would hate to find out that they have "benchmarked" my schedules and decided to offer me some consulting services by contacting layers of management above me. >

Or worse. A situation in California regarding a consultant developing retention schedules for various local governments brings home the issue of "buyer beware." Apparently a local consultant (who is a former local government employee) has developed several retention schedules for various Cities and Counties in California. When the local governments attempted to revise and/or share their retention schedules they were sued by the consultant who is claiming copyright on the schedules (and requires she must be hired to revise the schedules). Some of the governments have settled out of court, others are still in litigation. A similar situation exists with the California Secretary of State (although I don't know if it involves the same consultant. The CA SoS is responsible for providing RIM guidance to state and local government. The general retention schedule developed for Counties is no longer available by internet because of a copyright issue with the firm that developed the schedule. Read every contract very, very carefully.
