I would add one corallary to Jesse's example. 

If it ihis normal and legal business practice to delete 75% of the email he receives because it is not a record and therefore of no value to his business, then he is justified in having only retained 25% of the e-mail received.  The 75% were deleted in the normal course of business.

Obviously, he would suspend the deletion for any e-mail that become subject to a litigation hold regardless of record value.  So after having received a subpoena, his retention rate would be expected to rise.
