The key issue here is going to be the record sources that the "e-search" tool is going to be working on. The challenge with several of these vendors is that while the tool itself works somewhat close to what is being mentioned, the hard part is going to be in ensuring that the sources of ESI is easily integrated with the tool.

Case in point are going to be ESI in structured systems - most organizations will have COTS packages, home-grown and legacy systems and getting the e-discovery tool to extract the record sets will be no easy task. Similar is the case with the associated ESI metadata - how well the e-search and discover toolset works will be less contingent on the capabilities of the tool but more on the availability of metadata in order to search for the correct parameters e.g. author, dates, versions, keywords etc.

In evaluating the marketplace some of the factors that should be considered include:
- How well the vendor offering integrates with data sources - unstructured, semi-structured and structured(if there is a business need to do so)
- Maintain integrity of and with source data - vendor offering should provide a means to authentically store the result set and tie it to the metadata that is being searched for
- Track litigation and preservation notices and tie them to the appropriate ESI sets. Allow "re-use" of searchr results for similar or recurring litigation requests
- Ability to auto-categorize result sets by formats, metadata, data source, data type etc
- Ability to present ESI information in a customizable way to meet the litigation request (e.g. native format, export to desired format etc)
- Efficiently support redaction, de-duplication etc
- Appropriate access controls - ensure data integrity is not compromised
- Retention and disposition enforced

Automating e-discovery is beginning to show promise and as vendor offerings mature, this segment will provide a tremendous lift to pre-production processes.

Hope this helps in some way...

Thanks
Ganesh Vednere

Subject: E-discovery "Filtering" Products

List:
Long-time lurker here, needing advice, comments, etc. regarding litigation
pre-production eDiscovery platforms.

One product claims that their solution can greatly reduce expense (as much
as 80%) for legal e-discovery, regulatory inquiries, and corporate
investigations through their "cull-down or filtering" of large datasets of
email and documents to much smaller, relevant datasets.

Does anyone have experience with selecting and/or using these e-search
engine technologies and indexing algorithms and techniques?

On or off-list, all comments appreciated.
Thanks.
