Federal laws cover pieces of PII and often only apply to federal agencies, however some that would apply to state and county government include:

·         Gramm-Leach-Bliley governs the privacy of personal financial information

·         HIPAA governs the privacy of medical information

·         The Driver's Privacy Protection Act governs disclosure or availability of personal information obtained in connection with a motor vehicle record

·         The Children's Online Privacy Protection Act Governs personal information collected online that can serve to identify an individual child.



State laws vary from state to state.  You might want to check Wyoming statutes §§40-12-501 - 502 (Data (Security) Breach) and §6-3-901 (Identity Theft).  In the case of the latter, should someone use PII garnered from public records posted on the web, then the victim may sue the state or county for release of the information.

Greetings from Wonderful Wyoming,

I have had an interesting issue come up. Are there any federal rules or statues prohibiting the posting of PII on the web? I have some counties who are considering this action. the want to post their filing records on line w/o redacting any PII.

I could use some help in this.
