Todd Chernikoff asked about whether records and information, including ESI, that are on Legal Hold could constitute a separate record series in a schedule (hope I’m paraphrasing this accurately, Todd).

My opinion is: absolutely not.  A retention schedule is supposed to pertain to an organization’s normal course of business.  A legal hold suspends such activities for as long as the action to which it applies is in effect.  So, records and information responsive to the legal hold would be considered, as Todd suggests, as part of the corpus of that litigation (or other action).
